Trustee has no right to check my bank account after the 341 meeting, matter of fact it’s against the law.     In Georgia, currently in Chapter 13. If we receive an inheritance can we request to keep enough funds to pay for dental work? Also, we gave up one vehicle but have a need for an additional one. Could I request the portion of funds from the inheritance to pay for the dental work and enough to buy a second vehicle? Thanks

      Yes. Those are both very good reasons to request to retain funds in a chapter 13 case.

    Howdy! Great informational vids! My question to you is: If I had my 341 meeting and 3 weeks later, I receive a job offer that pays $20,000 more a year than what I'm currently making, am I still obligated to let my attorney know? Inquiring minds want to know :)

    Up here in Massachusetts my husband is filing a chapter 13 he's never filed anything in his life before but we just have so much credit card debt and we have quite a bit of assets and so we gotta go to attorney we paid good money we were going in for chapter 7 but She said we need to do a 13 to protect your assets and that over a five year period you will be able to pay down your debt and then you'll be done and we've given all the paperwork to her and done everything correct but the filing hasn't happened yet because we need to do a quick claim deed she said it is to protect our property during the filing and the bankruptcy the only ones on the deed in the Homestead paperwork for our house is me and my husband that's it and she said I have to come off of the deed And we need to do the quick claim deed and that this will help protect our home so the trustees can't touch it we're making payments regularly there's no problem there and we went to our attorney who helped us when we refinanced our home two years ago we asked him to change the deed and take my name off $300 later my name is taken off but the wording on the new deed my attorney doesn't like it she says it's not correct and that it's not the right deed that they need so now my attorney who handled the changing of the deed that we paid $300 to doesn't understand why we have to change the deed to a quick claim deed and we've been going back-and-forth with him about it and finally he says give me $200 more and I will change it into the quick claim deed I don't wanna pay another $200 when he should've done that I think the first time but he's not rehearsed in bankruptcy he's only a property attorney not a Bankruptcy attorney. so now my husband's bankruptcy attorney tells us that here's the paperwork sent to the email go to the county deed office and fill it out get it notarized and pay the small fee which I think is $35 I'm not sure but it could end up being more than that and get this done so she can file my husband chapter 13 and I'm just really confused and I've tried to have her explain it to me as to why we have to do this again and she says that it's just to protect our home and I cried because my name had to come off of the deed on the house and I can't put it back on until five years from now And is my husband still gonna be the owner of our home on the quick claim deed all by himself or is he surrendering our home in the bankruptcy and we just don't know it I'm totally still confused I've watched a lot of your videos I somewhat try to understand everything but it's so hard I just need more clarity anything you can maybe help me with would be great like I said again I'm up here in Massachusetts I know that you're not from here but maybe just help me to understand why the attorney wants this done is it really to protect our property I have paperwork for you to look at if you think you need to look at it to understand what I'm talking about but I don't think that I will need to do that for you but I would if you felt necessary thank you for your time and thank you for your videos they are quite Clearing understandable and useful it's just it's the wrong state but thanks again.     I'm confused. So if you file chapter 7... which is suppose to wipe out your debt and you have a pending lawsuit. The crooked ass trustee. Which is absolutely disgusting that that asshole would get a cut. Because you already have a lawyer working the lawsuit. One again. The crooked ass trustee... Anyway.     We are not behind on anything,credit cards or mortgage.Our credit is perfect.We are trying to get out from under a semi truck we bought . We're losing money and want to just give it back.       Of course! Not sure where you are located though because each district treats this issued differently. Majority of courts will say that the money is property of the estate and should be distributed to unsecured creditors. If you are already paying back at 100% then no big deal but if not then you may want to talk to your attorney about reasons the court will accept to allow to retain some of the money.

There isnt a lot on the web in regards to this issue and the 180 day rule, does that put you into a 100% plan, how much does a monthly payment go up, etc. Im just kinda freaking out and your vids are so informational, but didnt see any on Inheritance.     If I'm currently in a Chapter 13 and I want to relinquish my secured debt, is a Chapter 7 better or to just have a dismissed Chapter 13?

      Toya King not anymore. The law was just changed this year so we don’t count that as income on the means test.

    Hello Ms. Saedi, My husband & I were clients of yours around 2005. We filed a Ch. 13 & my student loans were included. One of the loans was fraudulent & was discharged, the other one is in collections. It was supposedly taken out in 1993, now I have made payments throughout the yrs. I am disabled & the collection agencies have been taking payments out of my disability benefits check. They sell it to another collector & they just continue to take my money. I am in the process of trying to get it forgiven, through borrower defense. I tried in the past to get it forgiven because I can't work & got denied. I provided what they asked for yet still got denied. What can I do to fix this, it's hurting me financially? I never even got my diploma. The school lost its accreditation & shut down. I was never even suppose to have any loans because the school said a grant should've covered my tuition, my income was very low. Can't seem to find any evidence that I received a grant for that school. Any advice would be greatly appreciated! Thx

    Hi Ms. Saedi, It is so nice to see you again! You & Ms. Hood helped my husband & I over 10 yrs ago when we were in a desperate situation. You & Ms. Wells were a team...Since then I have learned a lot about mortgages, bankruptcies, scams, mortgage fraud, etc. Thanks for your help you/your team...you were honest, upfront, to the point & accomplished the ultimate goal for us!
